These Terms and Conditions govern the provision of gardening services by our company in Edmonton. They outline the rights and obligations of both the service provider and the client.

2. Services Offered

  • Garden Maintenance: Regular upkeep including mowing, weeding, and trimming.
  • Landscaping: Designing and installing garden layouts, plant selection, and soil preparation.
  • Seasonal Services: Spring planting, autumn clean-up, and winter protection of plants.
  • Specialized Services: Pest control, irrigation system installation, and tree care.

All services are billed based on the scope and duration of the project. Payment is due upon completion of the service unless otherwise agreed upon in writing. We accept various payment methods including cash, credit cards, and bank transfers.

4. Client Responsibilities

  • Access: Clients must provide unobstructed access to the property during scheduled service times.
  • Property Condition: Ensure that the garden area is free from hazards that could impede service delivery.
  • Communication: Promptly inform us of any changes or specific requirements related to the services.

5. Service Limitations

Our services are limited to the information provided at the time of agreement. We are not responsible for:

  • Unforeseen site conditions that prevent the completion of services.
  • Damage resulting from extreme weather conditions or natural disasters.
  • Pre-existing plant diseases or pest infestations unless explicitly covered in our service agreement.

6. Cancellation Policy

Clients may cancel or reschedule services with at least 48 hours' notice. Cancellations made within 48 hours may incur a cancellation fee equivalent to 20% of the service cost.

7. Liability

We strive to perform our services with the highest level of professionalism. However, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the total amount paid for the specific service in question.

8. Dispute Resolution

In the event of any disputes, both parties agree to seek resolution through mediation before pursuing legal action. This approach aims to resolve conflicts amicably and efficiently.

9. Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta. Any legal actions related to these terms must be filed within Alberta's jurisdiction.

10. Amendments

We reserve the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes through email or our official communication channels. Continued use of our services constitutes acceptance of the updated terms.

11. Confidentiality

All client information and project details are kept confidential. We do not share or disclose any personal or project-related information to third parties without explicit consent, except as required by law.

12. Force Majeure

We are not responsible for delays or failures in service delivery caused by events beyond our control, including but not limited to natural disasters, acts of government, or pandemics.

13. Independent Contractors

Our gardeners are independent contractors and not employees. They are responsible for their own taxes, insurance, and compliance with local regulations.

14. Equipment and Materials

We provide all necessary equipment and materials for the agreed-upon services. Clients are responsible for ensuring that pets, children, and other vulnerable individuals are kept away from work areas to prevent accidents.

15. Insurance

We carry liability insurance to cover any accidental damages that may occur during service delivery. Proof of insurance can be provided upon request.

16. Termination

Either party may terminate the service agreement with written notice if the other party breaches any of the Terms and Conditions. Termination does not absolve the client from paying for services rendered up to the termination date.

17. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

18. Entire Agreement

These Terms and Conditions constitute the entire agreement between the client and our Gardening Services in Edmonton, superseding any prior agreements or understandings.
